I think the suggestion that he move to the passenger seat is dangerous - with the vehicle running, it is always best to have someone at the controls in case of any unexpected failure in the vehicle (e.g. slips into gear). The guy should have appealed, as there was no basis for the search, and he was not operating the motor vehicle in any conventional sense. The judge was an idiot (not the only one, I might add).
